Letter from the HOA President Concerning Payment of 2105 Dues
To All Falls of Cherokee/Ridgeview Property Owners:
On December 15th 2014, Access Property Management
sent all property owners their 2015 Home Owners Association annual dues
statement. That statement indicated a payment due date of January 1 2015, with
a late charge being assessed if not paid by January 15, 2015. This dues billing
statement was completely in line with our published Covenants, which state that
the annual dues assessment becomes delinquent 15 days after the due date and
that the HOA “may” choose to impose a 10% penalty on the unpaid balance.
What apparently has caused confusion is that the “delinquent
date” on the statement sent last year for the 2014 billing, by our previous
property management company, stated February 1. That date was in error and not
in line with our Covenants. However, that erroneous date caused some property
owners to be confused who may not have seen the 2015 delinquency date on this
For that reason, the HOA Board has decided to waive the
delinquency fee for anyone who has been assessed that fee for failure to pay by
January 15, 2015. That fee, however, will stand for anyone who is delinquent
after February 1, 2015.
We apologize for the concern and inconvenience. We will
insure that next years dues assessment statement is sent out well in advance
and will be very clear in stating that the delinquency fee is only assessed if
not paid within 15 days after the due date of January 1.
